Article 217: Appointment and conditions of the office of a Judge of a High Court
In plain words
High Court Judges are appointed by the President after consultation as set out in the text, and hold office until the age of sixty-two years, or as provided in article 224 for additional or acting Judges. To qualify, a person must be a citizen of India and have held judicial office in India, or been a High Court advocate, for at least ten years.
- A Judge can resign in writing to the President, and can be removed in the same way as a Supreme Court Judge under clause (4) of article 124.
- A Judge's office is vacated on appointment to the Supreme Court or transfer to another High Court.
- Questions about a Judge's age are decided by the President after consulting the Chief Justice of India, and that decision is final.
- The printed text refers to recommendation by the National Judicial Appointments Commission. The amendment that inserted that wording was declared unconstitutional by the Supreme Court.
