Section 195: Other sums
The Income-tax Act, 1961 was repealed by the Income-tax Act, 2025 from 1 April 2026. The text is kept here because the judgments below apply it.
In plain words
Anyone paying interest or any other sum chargeable to tax to a non-resident, other than salary, must deduct income tax at the rates in force when the amount is credited or paid, whichever is earlier.
- Crediting the amount to a suspense or similar account counts as credit to the payee.
- The duty applies to every payer, resident or non-resident, whether or not the non-resident has any place of business or presence in India.
- If the payer thinks only part of the sum is taxable income of the recipient, they can apply to the Assessing Officer to fix the portion on which tax must be deducted.
- Courts have held that tax need be deducted only on the part of the payment that is income chargeable to tax in India.
