Income-tax Act, 1961 · Chapter XX: Appeals and Revision · C.—Reference to High Court
Section 260: Decision of High Court or Supreme Court on the case stated
The Income-tax Act, 1961 was repealed by the Income-tax Act, 2025 from 1 April 2026. The text is kept here because the judgments below apply it.
In plain words
When the High Court or Supreme Court decides a reference, it must give a reasoned judgment and send a copy to the Appellate Tribunal, which then passes orders to dispose of the case in line with it. After an appeal under section 260A, the Assessing Officer gives effect to the High Court's judgment on a certified copy.
- Costs of a reference are in the court's discretion.
