Understanding this section
Section 2 holds the definitions that decide most disputes under the Act. This note concentrates on clause (oo), retrenchment, which defines when the protections of sections 25F to 25H apply. Retrenchment means termination of a workman's service by the employer for any reason whatsoever, other than as a disciplinary punishment, with a short list of exclusions.
Narrow reading, then wide
In 1956 the Supreme Court read retrenchment in its ordinary sense: discharge of surplus staff by a running business. From the mid 1970s the Court read the words for any reason whatsoever literally, so that almost every termination is retrenchment unless an exclusion applies. In 1990 a Constitution Bench settled the matter in favour of the wide reading.
The exclusions
| Clause | Not retrenchment |
|---|---|
| Main words | Termination as punishment after disciplinary action |
| (a) | Voluntary retirement |
| (b) | Superannuation, if the contract provides for it |
| (bb) | Non renewal of a contract on expiry, or termination under a stipulation in the contract, added in 1984 |
| (c) | Termination on the ground of continued ill health |
Clause (bb) and its misuse
Clause (bb) lets employers end genuine fixed term engagements without retrenchment compensation. Courts check whether the fixed term is genuine or a device to deny protection, for example by repeated short appointments with artificial breaks. Where the term is genuine, sections 25F, 25G and 25H do not apply.
Key Supreme Court rulings
Hariprasad Shivshankar Shukla v. A. D. Divikar 1956 INSC 72
Retrenchment in section 2(oo) had its ordinary meaning of discharge of surplus labour by an employer, and did not cover termination on a bona fide closure of the business.
State Bank of India v. N. Sundara Money 1976 INSC 3
Termination for any reason whatsoever includes the automatic end of service under a term in the appointment order, which is retrenchment.
Punjab Land Development and Reclamation Corporation Ltd. v. Presiding Officer, Labour Court 1990 INSC 186
A Constitution Bench held that retrenchment in section 2(oo) is to be given its wide literal meaning, covering termination for any reason other than the stated exclusions.
Bhavnagar Municipal Corporation v. Salimbhai Umarbhai Mansuri 2013 INSC 471
Termination of a helper on expiry of a fixed term appointment fell within clause (bb), so it was not retrenchment and sections 25G and 25H did not apply.
Common mistakes
- Relying on the 1956 narrow meaning after the Constitution Bench ruling.
- Accepting every fixed term label at face value under clause (bb).
