Code of Criminal Procedure, 1973 · Chapter V: Arrest of Persons

Section 41B: Procedure of arrest and duties of officer making arrest

The Code of Criminal Procedure, 1973 was repealed and replaced by the Bharatiya Nagarik Suraksha Sanhita, 2023 from 1 July 2024. It still applies to matters and proceedings from before that date, as the repealing law provides.

Now in the BNSS section 36 (Procedure of arrest and duties of officer making arrest)

In plain words

Every police officer making an arrest must wear clear, visible identification of their name, and prepare an arrest memo attested by at least one witness (a family member or respectable local person) and countersigned by the arrested person.

  • Unless a family member attested the memo, the person must be told they have a right to have a relative or friend informed of the arrest.
