Constitution of India · Part XVIII: Emergency Provisions
Article 358: Suspension of provisions of article 19 during emergencies
In plain words
While an Emergency on grounds of war or external aggression is in operation, article 19 does not restrict the State's power to make laws or take executive action. Such laws stop having effect when the Emergency ends, except for things already done.
- This applies only to laws that state they relate to the Emergency, and to executive action under such laws.
- If the Emergency covers only part of India, it can apply elsewhere so far as India's security is threatened by activities in or relating to that part.
