Constitution of India · Part XVIII: Emergency Provisions
Article 359: Suspension of the enforcement of the rights conferred by Part III during emergencies
In plain words
During an Emergency, the President can by order suspend the right to go to court to enforce Fundamental Rights named in the order, except articles 20 and 21, and pending cases on them, for the Emergency or a shorter period.
- While the order is in force, those rights do not restrict the State's power to make laws or take executive action, but such laws stop having effect when the order ends.
- This applies only to laws that state they relate to the Emergency, and to executive action under such laws.
- The order can cover all or part of India, and must be laid before each House of Parliament.
